AccuDraw Phlebotomy School

Please read these terms and conditions and refund policy below carefully before using Our Service.

Enrollment Agreement

To successfully complete the phlebotomy program, every student will be required to perform the tasks and functions they are learning.

A minimum $100 deposit must be paid in order to hold your seat in the class. The remainder must be paid in full the first day of class.

You will not receive your certificate of training until the course is paid for in full.

AccuDraw Phlebotomy School is a post secondary education facility. We do require that all students who enroll in the phlebotomy course possess a high school diploma, General Education Development (GED) Certificate or be in high school to take the course.

We do not acknowledge credit to students for other programs/courses taken.

We do not guarantee jobs or positions as part of taking this course.

100% Attendance is mandatory for all students. A student can make up a class no charge on the dates posted on the website.

A student's behavior is very important in taking this class. If for any reason a student is violent towards another student or the instructor or disruptive in any way and has had three warnings, they will be removed permanently from the program/course without refund or their certificate of completion.

We do not offer job placement. We do not guarantee hourly wage levels for this type of training.

Refund Policy

Students may request a full refund at any time before attending the course. Once a student has attended the course, no refunds will be provided.

Students may also request to reschedule their course to a different date. To request a refund or reschedule, students must contact us by email.

LIABILITY WAIVER AND RISK ACKNOWLEDGMENT

Student Assumption of Risk

BY ENROLLING IN THIS PROGRAM, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND VOLUNTARILY ASSUME ALL RISKS associated with phlebotomy training, including but not limited to:

  • Needlestick injuries and blood-borne pathogen exposure
  • Infections of any kind, including bacterial, viral, or other communicable diseases
  • Illnesses or conditions of unknown etiology (unknown cause)
  • Allergic reactions to medical supplies or equipment
  • Physical injury from medical equipment or procedures
  • Transmission of communicable diseases between students or from patients
  • Emotional distress related to medical procedures
  • Property damage or loss

Release of Claims

YOU HEREBY RELEASE, WAIVE, AND DISCHARGE AccuDraw Phlebotomy School, ALL independent contractors, instructors, employees, agents, and any other parties involved in providing educational services from any and all liability, claims, or demands for injury, damage, or loss arising from your participation in this educational program, including but not limited to:

  • Any injury, disability, or property damage
  • Negligent acts or omissions by instructors or staff
  • The condition of training facilities or equipment
  • Any aspect of your educational experience

Student Indemnification

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS AccuDraw Phlebotomy School, ALL independent contractors, and ALL instructors from any claims, damages, or expenses (including attorney fees) arising from:

  • Your actions or behavior during training
  • Your breach of these terms and conditions
  • Any third-party claims related to your participation
  • Your violation of safety protocols or applicable laws

Independent Contractor Operations

IMPORTANT NOTICE: AccuDraw Phlebotomy School operates through independent contractors at various locations. These contractors are separate business entities, not employees of AccuDraw.

YOU UNDERSTAND AND AGREE THAT:

  • Each location operates independently
  • You cannot sue or hold liable either AccuDraw OR the independent contractors
  • AccuDraw is not liable for the actions of independent contractors
  • Independent contractors are not liable for AccuDraw's actions
  • AccuDraw is not responsible for the condition of contractor facilities
  • Your instructor may be an independent contractor with the same liability protections

Needlestick and Injury Policy

Safety Protocol

All students must follow proper safety protocols when handling needles and other medical equipment during training. Students are required to use universal precautions and follow all safety guidelines provided by instructors.

Incident Reporting

Any needlestick injury, blood exposure, or other injury that occurs during training must be immediately reported to the instructor. Students must complete an incident report for any injury or exposure.

Medical Treatment and Student Responsibility

In the event of a needlestick injury or blood exposure:

  1. The affected area should be immediately washed with soap and water
  2. Students should seek appropriate medical evaluation and treatment
  3. Students are solely responsible for any medical costs related to treatment of injuries
  4. Follow-up testing and treatment decisions are the responsibility of the student and their healthcare provider

No Liability for Medical Expenses

AccuDraw Phlebotomy School, independent contractors, and instructors are NOT responsible for:

  • Medical expenses of any kind
  • Lost wages or income
  • Pain and suffering
  • Disability or permanent injury
  • Infections or communicable diseases contracted during training
  • Illnesses or conditions of unknown etiology that develop during or after training
  • Follow-up medical care or testing
  • Any costs related to injuries or infections occurring during training

Students participate in hands-on training AT THEIR OWN RISK.

Prevention and Removal

Students are expected to maintain focus and follow all safety protocols to minimize the risk of injury. Any student who repeatedly fails to follow safety protocols may be removed from the program without refund.

Insurance Recommendations

STUDENTS ARE STRONGLY ENCOURAGED TO MAINTAIN:

  • Adequate health insurance coverage
  • Personal liability insurance
  • Any professional liability insurance required in your state

AccuDraw does not provide insurance coverage for students.

LIMITATION OF LIABILITY

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AccuDraw Phlebotomy School's total liability for any claims shall not exceed the lesser of:

  • The amount you paid for your course
  • $500 USD

Excluded Damages

AccuDraw SHALL NOT BE LIABLE FOR:

  • Consequential, indirect, or punitive damages
  • Lost profits or business opportunities
  • Personal injury or wrongful death
  • Emotional distress or mental anguish
  • Property damage or loss
  • Costs of substitute training

Time Limit for Claims

Any legal claim must be brought within ONE (1) YEAR from when the incident occurred.

Professional Licensing and Certification Disclaimer

IMPORTANT DISCLAIMERS:

  • We do NOT guarantee state licensing approval
  • We do NOT guarantee national certification eligibility
  • We do NOT guarantee employment in healthcare
  • We do NOT guarantee recognition by healthcare employers

YOU ARE RESPONSIBLE FOR:

  • Researching licensing requirements in your state
  • Meeting all certification requirements
  • Obtaining required background checks or health screenings
  • Maintaining continuing education as required

Student success depends on individual effort, aptitude, attendance, and circumstances beyond our control.

"AS IS" and "AS AVAILABLE" DISCLAIMER

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, AccuDraw Phlebotomy School and its independent contractors, on their own behalf and on behalf of their affiliates and their respective licensors and service providers, expressly disclaim all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, AccuDraw Phlebotomy School and its independent contractors provide no warranty or undertaking, and make no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Educational Services Disclaimer: AccuDraw Phlebotomy School and its independent contractors make no warranty that the educational services will meet your individual learning needs, result in employment, certification by third parties, or any particular career outcome. Student success depends on individual effort, aptitude, attendance, and circumstances beyond AccuDraw's and its independent contractors' control. AccuDraw and its independent contractors do not guarantee that completion of our courses will result in state licensing, national certification, or employment in the healthcare field. Students are responsible for meeting any additional requirements for professional licensing or certification in their jurisdiction.

Without limiting the foregoing, neither AccuDraw Phlebotomy School nor its independent contractors nor any of their providers make any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or communications sent from or on behalf of AccuDraw are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

These terms are governed by United States federal law and the laws of the state where your training takes place.

Mandatory Arbitration

ALL DISPUTES must be resolved through binding arbitration administered by the American Arbitration Association, not through court litigation.

Individual Claims Only

You agree that disputes will be handled individually, not as part of any class action or group lawsuit.

Attorney's Fees

If any legal action is brought against AccuDraw Phlebotomy School or independent contractors by a student, the student agrees to pay all reasonable attorney's fees and costs incurred by AccuDraw and independent contractors in defending such action.

Interpretation and Changes

Sole Interpretation Rights

AccuDraw Phlebotomy School reserves the sole and exclusive right to interpret these Terms and Conditions. In the event of any ambiguity or dispute regarding the meaning of any provision, AccuDraw's interpretation shall be final and binding.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
